2019 Can’t Harley Believe It – Official Rules

1.NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

2.PROMOTION OVERVIEW: The 2019 Can’t Harley Believe It Promotion (the “Promotion”) is sponsored by  Gold Rush Amusements, Inc. (“Gold Rush”). The Promotion will be available to all Gold Rush Gaming establishments. Each participating establishment will have entry cards available for distribution on a first come, first served/requested basis to those who meet the eligibility requirements set forth in Rule 3 below. Entry Cards will be available to be distributed across all participating establishments. Limit one entry per person a day, while supplies last. On Friday, April 5^th, 2019 around 7pm a designated team member or a manager from the participating establishment will select at random from all eligible entries one (1) Grand Prize Finalist. The Finalist will win $100 in cash and will be entered into the Grand Prize Drawing that will be held on Friday, April 12^th, 2019 at 7:30pm at the Fox River Harley-Davidson in St. Charles, IL.

3.ELIGIBILITY: The Promotion is open to guests who are twenty-one (21) years of age or older at the time of entry and who are located in Illinois at the time of the participation in the Promotion (“Eligible Entrants”). Guests may be required to show a valid identification card (either a driver’s license or state ID) with the guest’s picture, name, address and age. Starting on Monday, March 11^th, 2019 Eligible Entrants at each participating establishment who request and receive an entry card shall be deemed “Participating Eligible Entrants”. Limit one (1) entry card a day (while supplies last) per Eligible Entrant. No purchase of any kind, or gaming of any kind, is required for an Eligible Entrant to receive an entry card, but if an Eligible Entrant is not a seated guest, such Eligible Entrant must request an entry card from a guest service host or manager at the participating establishment. You must be an Eligible Entrant to receive an entry card and you must be a Participating Eligible Entrant to participate or receive/win a prize or drawing entry. The following persons are ineligible to participate in the Promotion and/or to receive/win a gift/prize or drawing entry, even if they otherwise meet the definition of an Eligible Entrant: employees, officers, directors, agents, successors and assignees Gold Rush Gaming, their subsidiaries and affiliated companies, their advertising agencies, the participating establishments, and any entities or persons involved in any way with the creation, administration or fulfillment of the Promotion, and  the  immediate family members (defined as spouse, parent, child, sibling, or grandparent; whether biological, adoptive, step or in-law) and those living in the same household (defined as those persons whether related or not who live in the same residence as the Eligible Entrant at any time during the Promotion Period) of such employees, officers, directors, agents, successors and assignees. Void elsewhere and wherever prohibited or restricted by law.

4.PROMOTION DATES: The Promotion will begin on Monday, March 11^th, 2019 at 12:01am or at the start of the business day for each specific participating establishment and will end on Friday, April 5^th, 2019 around 6:50pm (10 minutes prior to the Grand Prize Finalist drawing that will occur around 7pm). The Grand Prize Drawing will take place on Friday, April 12^th, 2019 at 7:30pm at the Fox River Harley-Davidson in St. Charles, IL. Finalists must be present at the Grand Finale Drawing to be eligible to participate and win. All times for this Promotion are Central Time.

5.PRIZE DRAWING DETAILS: Each entry must be completed by the Participating Eligible Entrant with their full name and phone number and/or e-mail address and deposited into the entry box at the participating establishment where the entry was awarded. No other form of entry is allowed. All entries will remain in the entry box at the participating establishment until the completion of the entry earning period on Friday, April 5^th, 2019 around 6:50pm. The following outlines the prize distribution.

6. PRIZE WINNERS NOTIFICATION PROCEDURES: On Friday, April 5^th, 2019 around 7pm a designated team member or a manager from the participating establishment will select at random from all eligible entries one (1) Grand Prize Finalist. Potential winners do not need to be present at the time of the drawing to determine a win. Finalists will be notified of their selection via phone and if available e-mail at the e-mail address provided on the entry slip (the “Winner Notification”). If a winner (i) has not responded to Sponsor’s email or phone call within two (2) days; (ii) does not fulfill the eligibility requirements; (iii) does not adhere to these official rules; and/or (iv) does provide the required identification to Sponsor, the winner will be disqualified and an alternative winner may be selected by random drawing from among all remaining entries. On Friday, April 12^th, 2019 at 7:30pm at the Fox River Harley-Davidson in St. Charles, IL. a designated team member or manager from Gold Rush Gaming will select at random from all eligible entries three (3) Grand Prize Winners. Potential winners must be present at the time of the drawing to determine a win.

1. Grand Prize Drawing Claim Process: Potential Grand Prize Finalists must come to the Fox River Harley-Davidson located at 131 S. Randall Rd. in St. Charles, IL between 6-7:25pm to register as a participant in the Grand Prize Drawing. Each potential finalist must show a valid identification card (either a driver’s license or state ID) with the potential finalist’s picture, name, address, and age. Potential finalists may (in sponsor’s sole discretion) be required to complete, sign and submit a Prize Claim Forms which includes a liability and publicity release, where legal, before they will be able to participate as a finalist in the Grand Prize Drawing.
2. Grand Finale Drawing Details Upon registration and checking in, prior to 7:25 pm on April 12^th, 2019, all participating Grand Finale finalists will choose an envelope. The envelopes will contain a number from 1 to 200 (or less depending on the number of participating establishments).  The number in that envelope will be that individual’s assigned number for all purposes.  Finalists must keep their envelope and inserted number and may not trade with any other finalist or transfer their envelope and number to any other person(s).  An equal quantity of separate numbered envelopes will be used to identify which participant wins which prize.  The prizes will be randomly chosen in the following order from a drum containing the corresponding assigned numbers of each participant who had properly registered in person.  The holder of the first number drawn will win the Harley Iron 883 or cash option. The holder of the second number drawn will win the Harley Street Bob or cash option. The holder of the third number drawn will win the Grand Prize, the Harley Street Glide Special or cash option.  As each number is announced, the finalist with the matching number in their envelope must come to the drawing table to claim their prize. The Grand Prize Winners will be given an option of receiving either the Harley Davidson or check with the cash value of the Harley. If any of the Grand Prize winners opts for the Harley Motorcycle, details on how to receive the vehicle will be provided at the drawing table.

7.CONDITIONS: All taxes on Prizes are the sole responsibility of the winners. The Grand Prize winner will be required to provide tax information and will be sent an IRS Form 1099. Entry Cards are not transferable. One entry card per eligible entrant, per day for the entire Promotion. Sponsors are not responsible for lost or stolen entry cards. Only original entry cards are allowed. No copies or reproductions allowed. Sponsor is not responsible for lost, late, misdirected, incomplete, damaged or ineligible entries.

By participating, each Eligible Entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Promotion; (b) to release, discharge and hold harmless Sponsor, the participating establishments, and affiliated agencies or entities working on this Promotion, and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any Promotion­ related activity or the acceptance, possession, use or misuse of any Prize; and (c) in the case of winners in the Grand Prize Drawing, the right to use such winner’s name, photograph, quote(s), and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, without limitation and without compensation other than the Prize awarded. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Promotion without the prior consent of the Sponsor, which it may withhold in its sole discretion.

8.MISCELLANEOUS: Unclaimed Entry Cards will not be distributed. In the event of a discrepancy between these Official Rules and any creative/collateral materials relating to the Promotion, these Official Rules will prevail. Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or damaged entries, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the notification of winners, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Promotion. Persons who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void. Sponsors reserve the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof) for any or no reason, including if Sponsor determines that any portion of the Promotion is compromised for any reason, and, if terminated, at Sponsor’s discretion, Sponsors may select the potential winner(s) for the drawing(s) at issue from among all non-suspect, eligible entries received for the applicable drawing(s) prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

9.ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, Participating Eligible Entrants agree that (a) any and all disputes and causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Sponsor; (b) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will a Participating Eligible Entrant be permitted to obtain awards for, and Participating Eligible Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Participating Eligible Entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and Participating Eligible Entrant further waives all rights to have damages multiplied or increased.

10.CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois, USA. This Promotion is subject to compliance with the Illinois Video Gaming Act, Adopted Rules, and requirements of the Illinois Gaming Board. Sponsors reserve the right to revise these rules to comply with applicable law.
